Terms and Conditions

Welcome to Jobie! These Terms and Conditions ("Terms") govern your access to and use of the Jobie platform, operated by Jobie Inc. ("Jobie", "we", "us", or "our"). By accessing or using the Jobie services (the "Services"), you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use Jobie.
1. Introduction
Jobie is an online platform that connects Customers with Independent Contractors (referred to as Providers, Handymen, or Jobers) for various services such as babysitting, cleaning, home repairs, snow removal, and more. Jobie operates in Montreal, Toronto, and Vancouver, Canada. By using Jobie, you agree to abide by these Terms, which form a legally binding agreement between you and Jobie.
2. Eligibility
To use Jobie, you must:
- Be at least 18 years old and capable of forming a binding contract.
- Agree to comply with these Terms and all applicable laws and regulations.
- By using Jobie, you represent and warrant that you meet these eligibility criteria.
3. User AccountsAccount Creation:
- To access the Services, users (both Customers and Providers) must create an account by providing accurate and complete information.
- You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
Account Maintenance:
- You agree to keep your account information accurate and up-to-date.
- You must notify Jobie immediately if you suspect any unauthorized access to your account.
4. Services ProvidedJobie serves as a platform connecting Customers ("Users seeking services") with Independent Contractors ("Providers" or "Jobers") for various services. Services offered include, but are not limited to: babysitting, cleaning, snow removal, home repairs, and other on-demand services.Providers include individuals and agencies with a list of independent contractors offering services. Jobie is not involved in the actual delivery of services but acts as an intermediary for connecting users with providers.5. Independent Contractors
- Providers are independent contractors, not employees of Jobie. As such, Jobie does not control the manner or methods in which Providers perform the services.
- Jobie’s liability is limited solely to facilitating the connection between Customers and Providers. We are not responsible for any damages, injuries, losses, or disputes arising from the provision of services by Providers.
- Providers are responsible for the quality of the services they provide, and Jobie does not guarantee or warranty the services.
6. User ConductAcceptable Use:
- You agree to use Jobie solely for lawful purposes. You shall not engage in any activities that could harm Jobie, its users, or any third parties, or interfere with the platform's functionality.
Prohibited Activities:
You shall not:
- Use Jobie for illegal activities or misrepresentation.
- Engage in harassment, defamation, or abusive conduct towards other users.
- Attempt to bypass or interfere with the platform’s security measures or access controls.
7. Fees and PaymentsService Fees:
- Jobie charges a service fee for facilitating the connection between Customers and Providers. This fee is deducted from the payment made by the Customer to the Provider.
- Payment Processing: Payments for services are processed through the Jobie platform. All payments are handled via secure payment gateways.
Taxes:
- Jobie may collect applicable taxes, including VAT or sales tax, on behalf of Providers and remit these taxes to the appropriate authorities in accordance with applicable law.
8. Identity VerificationFor Providers:
- Providers must undergo an identity verification process, which may include submitting a valid identification card (e.g., passport, driver’s license, work permit) and a photo.
- Jobie reserves the right to verify Providers’ identity and background to ensure compliance with legal requirements. If necessary, Jobie may share information with law enforcement or regulatory agencies.
9. Dispute ResolutionDisputes Between Users:
- Jobie encourages users to resolve disputes amicably. If a dispute cannot be resolved directly between the parties, Jobie may, at its discretion, assist in facilitating the resolution process but is under no obligation to do so.
Arbitration:
- Any disputes, claims, or controversies arising out of or relating to these Terms, the use of Jobie services, or the relationship between users shall be resolved by binding arbitration under the laws of the Province of Quebec, Canada.
10. Limitation of Liability
- Jobie provides the platform "as is" and makes no representations or warranties regarding the quality, safety, or suitability of the services provided by independent contractors.
- Jobie’s liability is limited to the maximum extent permitted by law, and we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services.
11. Termination of Service
Jobie reserves the right to:
- Suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms or misuse of the platform.
- Upon termination, your access to Jobie will be revoked, and you will no longer be able to use the services or interact with the platform.
12. Intellectual Property
- All content available on Jobie, including but not limited to text, graphics, logos, icons, images, and software, is the property of Jobie or its licensors and is protected by copyright, trademark, and other intellectual property laws.
- You may not reproduce, modify, distribute, or create derivative works from any content on Jobie without prior written consent from Jobie.
13. Changes to the Terms
Jobie reserves the right to modify, update, or change these Terms at any time.
- Notification: Changes will be posted on the Jobie website or within the app, and the updated Terms will be effective immediately upon posting.
- It is your responsibility to review these Terms periodically. Continued use of Jobie after any changes indicates your acceptance of the updated Terms.
